Individuals with income under 125-200% of the federal poverty guidelines; eligibility depends on which funding stream clients are served under. Service Area: WNY. Cases in removal proceedings take place before the Buffalo Immigration Court, regardless of residence.

Application process

Call 716-847-0662 ext. 301 and leave a message. No walk-ins. For help regarding someone who has been arrested or detained by ICE at the Buffalo Federal Detention Facility, call 716-847-0752 and leave the detainee’s name, Alien Registration Number, and country of origin.

Fees

Free for legal services, but client must pay out-of-pocket expenses.

The Buffalo Non-Detained Program provides representation to non-citizens in removal proceedings and representation before the United States Customs and Immigration Services (USCIS) so they may begin safe, independent lives in the Western New York. We also serve as the non-profit attorney representative on the WNY Human Trafficking Task Force along with federal, state, and local law enforcement agencies, in federal and local prosecutors, and anti-trafficking social services providers. Houses several projects, including a "public defender" style program for men detained at the Buffalo Federal Detention Facility in Batavia and women detained by ICE in Allegany and Niagara County Jails.
